Terms of Use Agreement

These Terms of Use (“Terms”) govern your access to and use of the Ohana Rental Solution web application, mobile applications (if any), and related services (collectively, the “Service”) provided by Ohana Rental Solution, LLC, a Hawaii limited liability company with its principal place of business in Honolulu, Hawaii (“Ohana”, “we”, “us”, or “our”).

1. Acceptance of Terms
By registering an account, accessing, or using the Service in any way, you agree to be legally bound by these Terms, our Privacy Policy, and any additional policies or guidelines incorporated by reference. If you do not agree, you must not use the Service. You represent that you are at least 18 years old and have the legal capacity to enter into contracts.

2. Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and/or sending notice via email or in-app notification. Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms.

3. Description of Service
Ohana Rental Solution is a software-as-a-service (SaaS) platform designed to assist property owners, managers, and landlords in managing residential rental properties. Features may include tenant screening, digital lease agreements, online rent collection, maintenance request tracking, financial reporting, tenant/resident portals, and communication tools. We are a technology provider only. We do not provide property management services, real estate brokerage, legal advice, or tax advice. You remain solely responsible for compliance with all applicable federal, state (including Hawaii Revised Statutes Chapter 521), and local laws.

4. User Accounts
You must provide accurate, current, and complete information during registration and maintain the accuracy of that information. You are responsible for all activity under your account and for safeguarding your login credentials. Notify us immediately of any unauthorized use or security breach.

5. Acceptable Use & Prohibited Conduct
You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable law
  • Post, upload, transmit, or store content that is fraudulent, defamatory, harassing, discriminatory, obscene, or otherwise unlawful
  • Impersonate any person or entity or misrepresent your affiliation
  • Engage in spamming, phishing, or sending unsolicited commercial messages
  • Attempt to gain unauthorized access to the Service, accounts, or systems
  • Interfere with or disrupt the Service or any networks/servers connected to it
  • Use any robot, spider, scraper, or other automated means to access or collect data
  • Reverse engineer, decompile, disassemble, or create derivative works based on the Service
  • Use the Service to develop a competing product or service

6. User Content
You retain ownership of any content you upload or submit (“User Content”). By uploading, you grant Ohana a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, host, store, reproduce, modify, create derivative works from, communicate, publish, publicly perform/display, and distribute such content as necessary to operate, promote, and improve the Service.

7. Payments & Billing
Certain features require a paid subscription. Fees are quoted in U.S. dollars and are non-refundable except as expressly stated. Subscriptions automatically renew unless canceled before the renewal date. We use third-party payment processors; your use of their services is governed by their terms. We may suspend access for non-payment.

8. Termination
Either party may terminate your account at any time. We may suspend or terminate access immediately for violations of these Terms, non-payment, suspected fraud, or any conduct we believe harms the Service, other users, or us.

9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OHANA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

11. Indemnification
You agree to indemnify, defend, and hold harmless Ohana, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, violation of these Terms, or violation of any third-party rights.

12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Hawaii, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in Honolulu County, Hawaii. You waive any right to a jury trial and to participate in any class action.

Privacy Policy

Ohana Rental Solution, LLC (“we”, “us”, “our”) is committed to protecting your privacy. This Privacy Policy describes how we collect, use, disclose, and safeguard personal information when you use our Service.

1. Information We Collect

  • Account & Profile Data: name, email address, phone number, mailing address, company name, tax ID (if provided), payment card information
  • Property & Rental Data: property addresses, unit numbers, lease start/end dates, rent amounts, security deposits, tenant names, contact information, emergency contacts, application documents, income verification, credit/background check results (collected and processed on behalf of property managers)
  • Usage & Technical Data: IP address, browser type/version, device type, operating system, pages visited, time/date of access, referring/exit pages, clickstream data
  • Cookies & Tracking Technologies: session cookies, persistent cookies, web beacons, analytics cookies (Google Analytics, etc.), advertising pixels
  • Communications: messages sent via the platform, support tickets, chat transcripts, emails

2. How We Use Your Information

  • Provide, operate, maintain, and improve the Service
  • Process payments, subscriptions, and financial transactions
  • Send transactional communications (invoices, receipts, account notifications)
  • Send marketing communications (with opt-out rights)
  • Perform analytics, research, and product development
  • Detect, prevent, and investigate fraud, abuse, security incidents
  • Comply with legal obligations, respond to lawful requests, protect rights/safety

3. Data Controller vs. Data Processor Roles
We act as the data controller for personal information we collect directly from property owners/managers (account, billing, usage data). We act as a data processor (or service provider under CCPA) for tenant/resident personal information that property managers upload or direct us to process through the Service.

4. Sharing & Disclosure of Information

  • With contracted service providers (payment processors, cloud hosting, email delivery, background/credit screening vendors)
  • In connection with business transactions (merger, acquisition, asset sale)
  • To comply with legal obligations, court orders, subpoenas, or government requests
  • To protect the rights, property, or safety of Ohana, users, or the public
  • With your consent or at your express direction

5. Your Privacy Rights
Depending on your state of residence, you may have rights under:

  • CCPA/CPRA (California) – right to know, delete, correct, opt-out of sale/sharing
  • VCDPA (Virginia), CPA (Colorado), CTDPA (Connecticut), UCPA (Utah), and similar laws

6. Data Retention & Security
We retain personal information only as long as necessary for the purposes outlined or as required by law (typically 7 years for financial and tax records). We use industry-standard technical and organizational measures to protect data, though no transmission or storage method is 100% secure.

7. Children’s Privacy
Our Service is not directed to individuals under 13 years of age. We do not knowingly collect personal information from children under 13.

False Account & Listing Policy

Ohana Rental Solution is committed to maintaining trust and accuracy in all listings and user accounts. Any deceptive, fraudulent, or misleading activity is strictly prohibited.

Prohibited Activities Include:

  • Creating multiple accounts using false identities, temporary emails, or stolen information
  • Impersonating any person, business, property owner, property manager, or licensed professional
  • Listing properties that are not available for rent, have already been rented, or are not under your control/authority
  • Posting materially inaccurate information about rental price, availability, condition, photos, amenities, or location
  • Using bait-and-switch tactics, fake urgency claims, or other deceptive marketing practices
  • Creating accounts or listings for the purpose of harassing, defaming, or harming other users

Enforcement:
We may immediately remove any false or misleading content, suspend or permanently terminate accounts, report violations to law enforcement when appropriate, and pursue any available legal remedies. No refunds will be issued for terminated accounts.

Trademark Usage Policy

“Ohana Rental Solution”, the Ohana logo, and certain other names, logos, designs, and slogans are trademarks and service marks of Ohana Rental Solution, LLC (collectively, “Marks”).

You may not use our Marks without prior written permission except as permitted under these Terms or applicable law (e.g., fair use). Unauthorized use may constitute trademark infringement and unfair competition.

Permitted Use (Limited)
You may use our word mark “Ohana Rental Solution” in plain text to accurately refer to our company or Service (e.g., “I use Ohana Rental Solution to manage my rentals”) provided you do not imply endorsement or create confusion.

Prohibited Use

  • Using our Marks in domain names, social media handles, app names, or product names
  • Using our Marks in a manner that suggests affiliation, sponsorship, or endorsement
  • Modifying, altering, or combining our Marks with other marks/logos
  • Using our Marks in a disparaging, defamatory, or otherwise harmful manner

Fair Housing Act & Anti-Discrimination Policy

Ohana Rental Solution strictly prohibits any use of the Service that violates the federal Fair Housing Act (42 U.S.C. §§ 3601–3619), the Equal Credit Opportunity Act, Hawaii Revised Statutes Chapter 515, or any other federal, state, or local fair housing or anti-discrimination law.

Prohibited Practices
Users may not express, in any listing, advertisement, communication, or action on the Service, any preference, limitation, or discrimination based on:

  • Race or color
  • National origin or ancestry
  • Religion or creed
  • Sex (including gender identity and sexual orientation)
  • Familial status (including having children under 18, pregnancy)
  • Disability (physical or mental)
  • Age (except as permitted by law for senior housing)
  • Marital status
  • Source of income (including Section 8 Housing Choice Vouchers – protected in Hawaii and many jurisdictions)
  • Any other protected class under applicable federal, Hawaii, or local law

This includes language such as “no kids,” “professionals only,” “English speakers only,” “ideal for single person,” or any other statement that indicates a preference or limitation based on a protected characteristic.

Our Role & Enforcement
We provide tools to help users comply with fair housing laws, but we are not responsible for ensuring individual user compliance. We will promptly review and may remove any listing, advertisement, message, or content that we determine (in our sole discretion) violates fair housing laws. Accounts that repeatedly violate this policy may be suspended or terminated.

How to Report a Violation
If you believe any content or user on the Service violates fair housing or anti-discrimination laws, please report it to:

You may also file a complaint with the U.S. Department of Housing and Urban Development (HUD) at hud.gov or with the Hawaii Civil Rights Commission.
